DIRECTIVE 94/9/EC OF THE EUROPEAN PARLIAMENT AND THE COUNCIL
of 23 March 1994
on the approximation of the laws of the Member States concerning equipment
and protective systems intended for use in potentially explosive atmospheres

пристроїв, призначених для застосування в потенційно вибухонебезпечних
середовищах»
THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION.

Having regard to the Treaty establishing the European Community, and in
particular Article 100a thereof,
Враховуючи Договір про створення Європейського Співтовариства, і зокрема
його статтю 100а,
Having regard to the proposal from the Commission (1),
Враховуючи пропозицію Комісії (1),
Having regard to the opinion of the Economic and Social Committee (2).
Враховуючи висновок Комітету з Економічним і Соціальним питанням (2),
Acting in accordance with the procedure referred to in Article 189b of the
Treaty establishing the European Community.
Діючи відповідно до процедури, викладеної в статті 189b Договору про
створення Європейського Співтовариства.
Whereas it is the duty of Member States to protect, on their territory, the
safety and health of persons and, where appropriate, domestic animals and
property and, in particular, that of workers, especially against the hazards
resulting from the use of equipment and systems providing protection against
potentially explosive atmospheres;
Беручи до уваги, що це — обов'язок держав-учасників на їхній території
захистити безпеку й здоров'я людей (і зокрема в належних випадках і
свійських тварин і майно) і особливо працівників, від небезпек що виникають
при застосуванні обладнання та пристроїв, що забезпечують захист від
потенційно вибухонебезпечних середовищ;
Whereas mandatory provisions within the Member States determine the level of
safety to be achieved by protective equipment and systems intended for use
in potentially explosive
atmospheres;
Беручи до уваги, що в межах держав-учасників рівень безпеки, що повинен
бути досягнутий запобіжними та захисними пристроями, призначеними для
застосування в потенційно вибухонебезпечних середовищах, визначають
обов'язкові положення технічних умов;
Whereas these are generally electrical and non-electrical specifications
having an effect on the design and structure of equipment which can be used
in potentially explosive
atmospheres;
Беручи до уваги, що ці технічні умови на електричне й неелектричне
обладнання впливають у цілому й на конструювання й на конструкцію обладнання,
що може використовуватися в потенційно вибухонебезпечних середовищах;
Whereas the requirements to be met by such equipment differ from one Member
State to another in respect of their extent and differing inspection
procedures;
Беручи до уваги, що вимоги в одній державі-учасниці, що пред'являються до
такого обладнання, відрізняються від вимог в іншій державі-учасниці, що
стосується їхнього обсягу і різноманітності методик приймального контролю
Whereas these differences are, therefore, likely to raise barriers to trade
within the Community;
Беручи до уваги, що ці відмінності можуть створювати бар'єри в торгівлі в
рамках Співтовариства;
Whereas harmonization of national legislation is the only way in which to
remove these barriers to free trade; whereas this objective cannot be
satisfactorily achieved by the individual Member States;
Беручи до уваги, що гармонізація національного законодавства, є єдиним
способом для усунення цих перешкод на шляху вільної торгівлі, тоді як
окремими державами-учасниками ця мета не може бути досягнута належним чином;

Whereas this Directive merely lays down the requirements vital to freedom of
movement for the equipment to which it applies;
Беручи до уваги, що ця Директива лише встановлює вимоги необхідні для
вільного переміщення обладнання, на яке поширюється її дія;
Whereas the regulations intended to remove technical barriers to trade are
required to follow the new approach provided for in the Council resolution
of 7 May 1985 (3), which requires a definition of the essential requirements
regarding safety and other requirements of society without reducing
existing, justified levels of protection within the Member States;
Беручи до уваги, що регламенти, спрямовані на усунення технічних бар'єрів
у торгівлі повинні дотримуватися нового підходу, передбаченого в резолюції
Ради від 7 травня 1985 року (3), що вимагає визначення основних вимог, що
стосуються, як безпеки, так і інших вимог висунутих суспільством без
зниження існуючих у державах-учасниках встановлених рівнів захисту;
Whereas that resolution provides that a very large number of products be
covered by a single Directive in order to avoid frequent amendments and the
proliferation of Directives;
Беручи до уваги, що резолюція передбачає охоплення однією директивою дуже
великої кількості виробів для того, щоб уникати частих змін і швидкого
збільшення числа Директив;
Whereas the existing Directives on the approximation of the laws of the
Member States to electrical equipment for use in potentially explosive
atmospheres have made positive steps
towards protection against explosions via measures linked with the structure
of the equipment at issue and which have helped to remove barriers to trade
in tins area;
Беручи до уваги, що наявні у держав-учасників Директиви щодо зближення
законів відносно електричного обладнання для використання в потенційно
вибухонебезпечному середовищі, дозволили зробити позитивні кроки в напрямку
захисту від вибухів за допомогою заходів, пов'язаних з конструкцією
розглянутого обладнання, і сприяли усуненню бар'єрів у торгівлі в цій сфері
діяльності;
Whereas, in parallel, a revision and expansion of the existing Directives is
necessary since, more particularly, in an overall context, action must be
taken to guard against the potential hazards arising from such equipment.
This implies in particular that measures intended to guarantee effective
protection of users and third parties must already be contemplated at the
design and manufacturing states;
Беручи до уваги, що одночасний перегляд і розширення царини дії існуючої
Директиви є необхідним, оскільки, зокрема, у загальному контексті, дії
повинні бути вжиті для захисту від потенційних небезпек, пов'язаних з таким
обладнанням. Це має на увазі, зокрема, що заходи, які покликані забезпечити
ефективний захист користувачів і третіх осіб повинні бути продумані вже на
стадіях проектування й виготовлення;
Whereas the form taken by the hazard, the protective measures and the test
methods are often very similar, if not identical, for both mining and
surface equipment; whereas it is,
therefore, absolutely necessary to cover by a single Directive protective
equipment and systems falling within both groups;
Беручи до уваги, що форма прояву небезпеки, захисні заходи й методи
випробувань найчастіше дуже схожі, якщо не ідентичні й для обладнання
підземних виробок шахт, рудників і для обладнання в їхніх наземних будівлях.
І беручи до уваги, що внаслідок цього вкрай необхідна єдина Директива, що
поширює свою дію на запобіжні та захисні пристрої, що входять в обидві
групи;
